CAPTAIN AMERICA: Civil War movie. Federalists v. Anti-Federalist?
Viewing Captain America: Civil War gives some perspective on modern American political idealism and how the founding fathers must have faced some of the same disagreements about federalism.
In the movie the Avengers split into two groups whether to allow a UN panel to oversee and control the Avengers. Iron Man and his group focus on granting this right in order to remain a unified front and gain the trust of the people. Meanwhile, Captain America and his group believe that sacrificing their freedom to the government allows for errors that will ultimately take away their individual rights and compromise their privacy and safety. |

After the leaders of the new United States wrote the Constitution, they had to get the thirteen states to agree to it. Some of the states didn't want to agree unless they could add some specific rights for individual people. So in 1791 the United States added ten new rights to the Constitution. These are called the Bill of Rights: the first ten amendments to the United States Constitution
The idea behind the Bill of Rights was to insure certain freedoms and rights to the citizens of America. It put limits on what the government could do and control. Freedoms protected include freedom of religion, speech, assembly, the right to bear arms, unreasonable search and seizure of your home, the right to a speedy trial, and more. |
Due Process amendments 4-8
Whether a trial is depicted in a movie, on television, or in real life, Americans cannot seem to turn away. From the crime itself, to the arrest, to the jury's verdict, Americans have been fascinated by the justice system.What rights can Americans claim if they are accused of crimes? The 4th, 5th, 6th, and 8th Amendments provide much of the constitutional basis of these rights.
Amendments 4-8 protect rights that apply to a person accused of a crime from when he or she is arrested or accused to when he or she is either convicted or found innocent. Rights of the accused are generally based on innocent until proven guilty" and are due process. |
The Fourth Amendment - this amendment prevents the government from unreasonable search and seizure of the property of US citizens. It requires the government to have a warrant that was issued by a judge and based on probable cause. The Fifth Amendment is famous for people saying "I'll take the Fifth". This gives people the right to choose not to testify in court if they feel their own testimony will incriminate themselves. In addition this amendment protects citizens from being subject to criminal prosecution and punishment without due process. It also prevents people from being tried for the same crime twice. The amendment also establishes the power of eminent domain, which means that private property can not be seized for public use without just compensation. The Sixth Amendment - guarantees a speedy trial by a jury of one's peers. Also, people accused are to be informed of the crimes with which they are charged and have the right to confront the witnesses brought by the government. The amendment also provides the accused the right to compel testimony from witnesses, and to legal representation (meaning the government has to provide a lawyer). The Seventh Amendment - provides that civil cases also be tried by jury. The Eighth Amendment - prohibits excessive bail, excessive fines, and cruel and unusual punishments. |

The Three branches of government
The Founding Fathers, the framers of the Constitution, wanted to form a government that did not allow one person to have too much control. With this in mind, the framers wrote the Constitution to provide for a separation of powers, or three separate branches of government. Each has its own responsibilities and at the same time they work together to make the country run smoothly and to assure that the rights of citizens are not ignored or disallowed. This is done through checks and balances. A branch may use its powers to check the powers of the other two in order to maintain a balance of power among the three branches of government.
